“Passagetaxi” suggests carefully reading the text of the public Offer, and in case of disagreement with any point, it is suggested to refuse the Services provided under the terms of this Offer, not to install (install) the “Passagetaxi” Application or to delete the installed Mobile application.
This document is a public offer and a public contract (hereinafter – Contract) and according to Art. 633, 641 and Chapter 63 of the Civil Code of Ukraine, addressed to any natural person (hereinafter – the User), is an official offer of “Passagetaxi”, that is, the company operating under the trade name “Passagetaxi” (hereinafter – “Passagetaxi”) and contains all the essential conditions for regulating relations arising between Users of the Website, Mobile applications “Passagetaxi” and “Passagetaxi Driver: manage, earn”.
1. PERSONAL DATA PROCESSING
- “Passagetaxi” processes personal data provided by passengers and drivers using the “Passagetaxi” Service, the Web site, “Passagetaxi” and “Passagetaxi Driver: drive, earn” mobile applications, in order to provide passengers with the services ordered by them.
- “Passagetaxi” processes the following personal data:
name, phone number, e-mail address.
geolocation of the vehicle and the passenger, the time of the trip and its destination.
payment information.
information on complaints.
identification data of the device on which the Mobile application is installed or the Web site is accessed
- Processing of personal data is carried out for the purpose of:
matching passengers with drivers and helping them move around cities more efficiently. disclosing passengers’ geolocation data and phone numbers to drivers to ensure the driver can identify the passenger. Geolocation data is collected only when the Mobile Application is activated. Geolocation data collection stops after closing the Mobile Application.
use of geolocation data to solve problems related to the provision of transportation services.
use of contact data for notifications about the availability of updates to the Mobile Application.
regarding route data for analysis in order to provide drivers with recommendations on the most rational routes.
name, phone number and email address will be used to contact passengers and drivers.
regarding bank and payment details – for processing data on passenger settlements with drivers for transportation services.
regarding appeals to the support service – for the purpose of solving complaints and questions about the quality of services.
- Personal data may also be processed on other legal grounds, in particular, in connection with the investigation and detection of fraudulent activities or other violations of the law.
- In some cases, when connecting to the Web site, “Passagetaxi” can automatically (ie without registration) receive technical information that is not personal data. Such information includes the type of Internet browser, the type of computer operating system, and the domain name of the Internet site that was used to access the Web site.
2. APPLICABLE LAW
- The terms of this Agreement are regulated and interpreted in accordance with the legislation of Ukraine.
- Issues not regulated by the Agreement shall be resolved in accordance with the legislation of Ukraine
- If, for one reason or another, one or more provisions of this Agreement are deemed invalid or unenforceable, this does not affect the validity or applicability of other provisions of this Agreement.
3. ACCESS TO DATA
- Personal data of passengers are disclosed only to the driver through the relevant Mobile application; in this case, the driver will see the name, phone number and geolocation data of the passenger.
- “OnTaxi” has the right to disclose and provide access to personal data to partners (local companies, representatives, agents, etc.). The processing of personal data in this case will be carried out under the same conditions as set out in this privacy policy notice.
4. DATA PROTECTION
- Personal data collected during the provision of services are sent and stored in data centers. “Passagetaxi” will take appropriate measures to ensure access to personal data only to persons authorized by “Passagetaxi” to ensure the functioning of the “Passagetaxi” Service.
- Geolocation information is processed anonymously and personalized only if it is necessary to resolve complaints or detect fraud.
- To conduct research. For marketing and scientific purposes, personal data is used in an impersonal (anonymized) form.
5. ACCESS TO PERSONAL DATA
- The owner of personal data can access and update his personal data through the Website and/or Mobile Applications.
6. STORAGE
- Personal data is stored as long as you have an active passenger account. If the account is deleted, the personal data will be deleted from the database, except if this data is necessary for accounting, complaint resolution or fraud prevention.
7. INFORMATION AUTOMATICALLY LOCATED ON THE COMPUTER – COOKIES
- When visiting the Website, “Passagetaxi” may store some information on the User’s computer. This information will be in the form of cookies (small files with data that are sent to the hard drive of the computer from the sites you visit) or similar and can be useful in solving various tasks. For example, cookies help to configure the website in such a way that it meets the interests and needs of the user as much as possible. With the help of most Internet browsers, the user can delete cookies from the hard drive, block any of their storage or receive a message that they will be stored. Please refer to your internet browser’s user manual or its built-in reference for details on these features.
8. REMOVAL
- The deletion of personal data is possible only under the condition of deleting the corresponding account and the Mobile application. As a result, it is not possible to use the Mobile Application through the account that has been deleted.
9. CONSIDERATION OF APPEALS
- “Passagetaxi” will respond within a month to any request for the transfer of personal data sent to e-mail. Applications will be considered only if the identity of the applicant can be identified.
10. MARKETING
- “Passagetaxi” can use existing e-mail addresses and/or phone numbers to send marketing messages only if consent is given through the Website or through the Mobile Application.
- If you do not wish to receive marketing messages, you can use the “Unsubscribe” link at the bottom of the message or in the profile of the Mobile application.
11. RESOLUTION OF DISPUTES
All disputes and disagreements that may arise during the implementation of this Agreement will be resolved by the Parties through negotiations. Written requests should be sent to the e-mail address passagetaxy@gmail.com
If it is impossible for the Parties to settle their differences, the dispute shall be resolved under the established jurisdiction and in the manner determined by the current legislation of Ukraine.
